It's unconstitutional, nonsensical, will NOT assist in finding illegals: some already have 'Gold Star' ids, & most don't fly and they tend to avoid Fed Bldgs).
DHS Plan is to eventually add your banking info, med records, and make your id mobile only!
First and foremost, the REAL ID Act infringes upon the Tenth Amendment by coercing states into aligning with federally imposed identification standards. Driverâs licenses have historically been managed at the state level, and the threat of denying residents access to air travel or federal buildings unless states comply constitutes de facto federal overreach.
Additionally, the REAL ID Act undermines Fourth Amendment protections by encouraging the creation of interlinked state databases containing sensitive personal data and biometric identifiers. These databases, though decentralized in theory, functionally establish a national identity registry vulnerable to abuse, surveillance, and identity theft.
Moreover, the Act potentially impairs First Amendment rights by making access to federal facilities contingent upon possession of a compliant ID. This restricts the publicâs ability to engage with government offices and representatives, especially for low-income individuals, religious objectors, and undocumented residents, who may face difficulty obtaining compliant identification.
Equally concerning is the burden the Act places on the right to domestic travelâa fundamental liberty not explicitly stated but long upheld by the courts. By making air travel contingent on compliance with federal ID standards, REAL ID risks disenfranchising citizens who are either unwilling or unable to comply.
Finally, the unfettered authority granted to the Department of Homeland Security to define the scope of âofficial purposesâ raises serious separation of powers concerns. The potential for âmission creepâ must not be underestimated.
For these reasons, Senate and House, we respectfully urge you to not support the REAL ID Act and advocate for its repeal or substantial reform. At minimum, we request that your State explore legal and legislative options to preserve state sovereignty and protect residentsâ privacy and constitutional rights. "
