Fairfax County, Virginia has implemented extensive sanctuary policies:
1. Law enforcement practices: The Fairfax County Police Department does not honor ICE detainers or deportation orders, and officers are barred from facilitating civil immigration enforcement under General Order 604, issued in June 2019.
2. Jail operations: The Sheriff’s Office, led by Sheriff Stacey Kincaid, does not honor ICE detainers and releases individuals per court orders, though ICE is automatically notified when someone is booked into the Adult Detention Center.
3. Prosecutorial stance: Commonwealth’s Attorney Steve Descano’s office has faced federal scrutiny for reportedly dropping or reducing charges against noncitizens, which critics say allows criminal aliens to avoid deportation and reoffend.
The policies are defended as necessary to build trust between immigrant communities and law enforcement, with county leaders asserting that immigration enforcement is a federal responsibility. However, they have drawn intense criticism from federal officials and Republican lawmakers, who argue the policies endanger public safety—citing cases where undocumented individuals released under these policies were later charged with violent crimes, including murder and child sex offenses. As of 2026, Fairfax County accounted for over two-thirds of Virginia’s 1,700 ignored ICE detainers between late 2022 and early 2025.
